  1. The 'animus' of Justice Scalia

In a 1996 Supreme Court decision protecting gays and lesbians from discrimination, Justice Anthony M. Kennedy wrote that Colorado voters had evidenced an unconstitutional "animus" toward homosexuality. Justice Antonin Scalia dissented, huffing: "I had thought that one could consider certain conduct reprehensible — murder, for example, or polygamy, or cruelty to animals — and could exhibit even 'animus' toward such conduct."

  5. Gay marriage: Scalia knew this day would come

In announcing Friday that it will hear two cases involving same-sex marriage, the Supreme Court did not include a statement from Justice Antonin Scalia saying “I told you so.” But the thought surely has crossed the conservative justice’s mind.

  7. Chan Lowe: Gay Marriage and the Supreme Court

Antonin Scalia is one person who comes to mind when you think of the bias against equal rights for gays dying one old person at a time. The problem is, he’s in a position to do some serious damage in terms of resisting the tide of history.

  9. Commentary: We Don't Have To Live With The Gun Violence

This time the shots didn't ring out in a movie theater in Colorado, or outside of a Safeway in Arizona, or a spa in Wisconsin, or a temple or a college campus. This time it was children, elementary school boys and girls in Newtown, their bodies carted out like battlefield casualties.

  11. Patron: An Israeli can't fathom America's love of guns

The NRA is today's Moloch — an ancient Canaanite god who required regular child sacrifices by fire to appease his rage against all humans.  Even though the Israelites were commanded to worship One God, they often lapsed into pagan rituals, including...

  13. Robert Bork, the original originalist

Robert Bork, who died Wednesday, occupies a peculiar position in the pantheon of American conservative heroes. Most conservatives celebrated Judge Bork as the champion of constitutional values who was denied his rightful position on the Supreme Court by liberals bent on warping constitutional language for partisan purposes. Constitutional conservatives for the past 25 years, however, have gone on precisely the sort of judicial crusade that Judge Bork condemned in his major writings. While Judge Bork and such contemporary justices as Antonin Scalia and Clarence Thomas share a superficial commitment to constitutional originalism, the originalism of the conservatives on the present Supreme Court bears little relationship to the originalism Mr. Bork pioneered during the 1970s and 1980s.

  17. Scalia must join 21st century and change gay marriage stance

The Supreme Court's announcement last Friday that it will take up gay marriage is more than a chance for the justices to recognize the emerging national consensus in support of gay rights. It is a chance for them to overrule the medieval views of...
