3. Board has a duty to protect owners from disruptive tenant

Question: I am very concerned about who's really running my gated community's association. A tenant next door suffers from severe problems. For the last year, three nights a week, he is either throwing furniture around, banging on the walls and screaming, or on his adjoining balcony endlessly talking to himself, then starts banging on patio furniture sometimes more than eight hours a day. He constantly threatens to kill himself and others. At night he brings home street people who scare the neighbors.

Last Week: The story of the week in my mind involved Chief Judge Peter Weinstein issuing an executive order requiring defendants accused of residential burglary to appear before a judge rather than being able to post an automatic bond. As an elected official I can speak first hand of the damage done by residential burglars who not only violate a person's privacy, but can cause extreme damage to an individual's quality of life through fear. Police Chief Ross Licata is to be complimented for his initiative in bring this to Weinstein's attention and the judge is to be lauded for his quick action. These are two public officials who have the community's interest in mind. It's also a very positive sign that the judge has ordered a complete review of the current bonding structure.
